Terms of Service

Welcome to MindForge. These Terms of Service ("Terms") govern your access to and use of the MindForge website at mindforge.games (the "Site") and all related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

1. Eligibility

You must be at least 13 years old to use MindForge. By using the Service, you represent that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Accounts

Registration

To access certain features, you must sign in using Google OAuth. By signing in, you authorize us to access limited profile information from Google (name, email, profile picture) as described in our Privacy Policy.

Account Responsibility

  • You are responsible for all activity under your account.
  • You must not share your account credentials or allow others to access your account.
  • You must notify us promptly if you suspect unauthorized access to your account.

Account Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time by contacting us at contact@mindforge.games.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Harass, threaten, or intimidate other users
  • Post content that is defamatory, obscene, hateful, or discriminatory
  • Impersonate another person or entity
  • Attempt to gain unauthorized access to the Service or its systems
  • Use automated tools (bots, scrapers) to access the Service without our written permission
  • Interfere with or disrupt the Service or its infrastructure
  • Upload malicious code, viruses, or harmful content
  • Circumvent any security measures or access controls
  • Use the Service to spam or send unsolicited communications

We reserve the right to remove content and suspend accounts that violate these guidelines at our sole discretion.

4. User Content

Your Content

"User Content" means any content you create, submit, or display through the Service, including game collections, ratings, votes, top-10 lists, comments, and feedback.

  • You retain ownership of your User Content.
  • By posting User Content, you grant MindForge a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content in connection with operating and improving the Service.
  • This license ends when you delete your User Content or your account, except where your content has been shared with others and they have not deleted it.

Content Standards

User Content must not:

  • Violate any applicable law or regulation
  • Infringe on the intellectual property rights of others
  • Contain personal information of others without their consent
  • Be misleading, fraudulent, or deceptive

Content Removal

We may remove User Content that violates these Terms or that we determine, in our sole discretion, is harmful to the Service or its users. We are not obligated to monitor all User Content.

5. Intellectual Property

MindForge Property

The Service, including its design, code, graphics, logos, and original content, is owned by MindForge and protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our written permission.

Third-Party Content

MindForge displays content from third-party sources, including:

  • BoardGameGeek: We use BoardGameGeek game IDs to link users to BGG game pages for additional game information. BoardGameGeek content is subject to their terms of use.
  • YouTube: Video content is embedded via YouTube and subject to the YouTube Terms of Service.
  • Game Publishers: Game names, artwork, and descriptions are the property of their respective publishers and used for informational purposes.
  • AI Services: We use third-party AI services (Anthropic Claude, OpenAI) to analyze publicly available video transcripts and generate factual game data summaries. AI-generated analysis is clearly distinguished from user-created content.

MindForge does not claim ownership of third-party content displayed on the Site.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or secure
  • Any defects will be corrected
  • The content on the Service is accurate or complete
  • The Service will meet your specific requirements

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINDFORGE AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM:

  • Your use of or inability to use the Service
  • Any content obtained from the Service
  • Unauthorized access to your account or data
  • Any third-party conduct on the Service

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

8. Indemnification

You agree to indemnify and hold harmless MindForge, its operators, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your User Content
  • Your violation of any third-party rights

9. Third-Party Services

The Service may contain links to or integrations with third-party services. We are not responsible for the content, privacy practices, or terms of any third-party service. Your use of third-party services is at your own risk.

10. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

11. Changes to These Terms

We may revise these Terms from time to time. We will notify users of material changes by posting a notice on the Site. The "Last Updated" date at the top indicates the latest revision.

Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved in the courts located in Texas, and you consent to the personal jurisdiction of those courts.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full effect.

14. Entire Agreement

These Terms, together with the Privacy Policy and DMCA Policy, constitute the entire agreement between you and MindForge regarding the Service and supersede any prior agreements.
